Terms of Use
By signing up for this course (“Course”) and clicking on the link https://communicatewithconfidence.thinkific.com to access the Course, you acknowledge and agree that:
1. the course educator, Jordana Borensztajn, (“Course Educator”) is not a registered psychologist or professional counsellor, financial planner, adviser, accountant, medical practitioner or legal advisor;
2. your participation in any activities, exercises or discussion during, or as a result of, the Course is strictly voluntary and you are solely responsible for your own well-being and assume all risks arising from my participation, including without limitation any potential emotional or psychological distress or discomfort you may experience;
3. the Course and its contents (including but not limited to all information, downloadable documents or materials, other materials, forecasts, assessment, recommendation, analysis, forward looking statements and strategies discussed and/or made available to you during the Course) (“Information”):
(a) is for provided for general information purposes or illustrative only;
(b) is of a general nature and does not purport to be complete nor to contain all information and considerations in relation to the subject matters contemplated in the Information and the Course;
(c) is not intended to be taken as (or be in substitution for obtaining) in substitution for obtaining independent professional legal, business, financial, marketing, medical or other professional advice; and
(d) is based on the personal experiences of the Course Educator as a keynote speaker, social media trainer, consultant, coach and educator (and of those she has learnt from) or is intended to be purely illustrative and you may have to modify, adapt or not use some of the Information and what you learn during the Course, do further research or seek professional advice to suit your individual personal, professional and/or financial situation;
4. to the fullest extent permitted by law, the Course Educator disclaims and excludes all representations, guarantees and warranties whatsoever, whether express or implied in fact or by law, in relation to the Information and the Course (or any part thereof), including but not limited to:
(a) the completeness, reliability, usefulness, currency or accuracy of the Information or the Course (or any part thereof);
(b) the suitability or appropriateness of the Information or the Course (or any part thereof) for your personal, professional or financial circumstances;
(c) your access or use of, or inability to access or use, or misuse of the Information or the Course (or any part thereof) and any direct or indirect consequences;
(d) the results, outcomes or consequences arising or resulting from your use or misuse of the Information or participation in the Course (or any part thereof);
(e) the quality or speed of streaming and functioning of any audio-visual technology used in connection with the Information or Course; and
(f) the reasonableness of any assumption contained in the Information or made during the Course (or any part thereof).
5. any inaction or action you take in reliance on the Information or Course (or any part thereof) is strictly at your own risk. To the fullest extent permitted by law, the Course Educator does not assume or accept any responsibility or liability, and you irrevocably and forever release and discharge the Course Educator, from any and all claims, losses, complaints, demands, actions, proceedings, judgments, damages, costs, expenses, liabilities or obligations whether present, future or contingent, and whether in respect of direct, indirect or consequential loss or damage, or loss or damage arising from negligence, or opportunity costs whether express or implied in fact or by law (“Loss”) suffered or incurred by you arising from or in connection with the Information or Course, including but not limited to any Loss suffered or incurred in relation to:
(a) each of the matters contemplated in clause 3(a) to 3(f) (inclusive);
(b) any mistakes, misrepresentations, misstatements, errors or omissions in the Information or the Course (or any part thereof);
(c) any corruption of the Information and/or any data or the transmission of any virus and other malicious software during or arising from your access or use of the Information or the Course (or any part thereof);
(d) any changes in law from time to time; and
(e) any breach in the security of confidential or personal information or data held, stored or maintained in connection with the Information or the Course (or any part thereof), including but not limited to any unlawful release, sharing or use of such information or data;
6. the Course Educator reserves all rights to and may discontinue, extend, shorten or reschedule the Course (or any session of the Course, if applicable) (or any part thereof), to revoke your access to the Information (or any part thereof) or withhold, change or remove the Information (or any part thereof) at any time and from time to time in her absolute discretion without prior notice;
7. you must not copy or record by audio, video, photography, or by any other means, any part of the Information or the Course or the Course Educator without the prior written permission of the Course Educator and any unauthorised copies or recordings will become the sole and absolute property of the Course Educator automatically upon its creation;
8. the Course Educator is the sole owner of all intellectual property (including copyright) in all the content, documents, materials, publications and recordings provided or made available to you in the Information or during the Course (“Works”), including all improvements to such Works, (except for any work created exclusively for you and your benefit during the Course as confirmed in writing by the Course Educator) and, except as expressly permitted under the Copyright Act 1968 (Cth) or other applicable laws, none of the Works or any part of it may be altered in any way, reproduced, adapted, transmitted or distributed to a third party without the prior written consent of the Course Educator;
9. you consent for the benefit of the Course Educator to all or any acts or omissions that would ordinarily constitute an infringement of your moral rights in relation to all intellectual property that you may create, develop or generate in the course of, or arising from, your participation in the Course or arising from your use of the Information. Moral rights has the meaning given to it in the Copyright Act 1968 (Cth) and includes:
(a) a right of attribution of authorship;
(b) a right not to have authorship falsely attributed; and
(c) a right of integrity of authorship;
10. you will, upon request by the Course Educator, immediately return to the Course Educator or destroy and permanently delete all copies of the Information (or any part thereof) in your possession or control as directed by the Course Educator from time to time;
11. you indemnify the Course Educator for any Loss on a full indemnity basis that the Course Educator may suffer or incur as a result of your use or misuse of the Information or participation in the Course (or any part thereof);
12. you confirm that you have read, understood and accept the terms of the Course Provider’s privacy policy (as amended from time to time);
13. you confirm that you have read, understood and accept the above terms and conditions (“Terms”); and
14. these Terms is governed by the laws of Victoria, Australia and the parties submit to the exclusive jurisdiction of the courts of Victoria, Australia in respect of all matters relating to, and all subject matters contemplated in, these Terms.
